Please read these terms carefully before accessing or using the Funbook platform.
These Terms & Conditions (“Terms”) govern your use of the Funbook platform (“Funbook”, “we”, “us”, “our”) and any related services, bookings, and vouchers made available through it.
By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform.
Funbook operates as an online marketplace and booking platform that connects customers with independent third-party merchants (“Merchants”).
Unless explicitly stated otherwise, Funbook is not the direct provider of the goods or services listed. Each Merchant is solely responsible for delivering their own products and experiences.
Funbook reviews all vendor applications and may approve or reject them at its discretion. Decisions may be based on factors such as platform policies, safety, legal compliance, operational needs, market demand, and local competition. Approval is not guaranteed, and Funbook may suspend or remove vendors who do not meet our standards or requirements.
- 3.1 All bookings are subject to availability and confirmation by the relevant Merchant.
- 3.2 Payment is required in full at the time of booking unless otherwise stated.
- 3.3 Prices are listed in NZD and include GST unless specified.
- 3.4 Once payment is processed, a confirmation email and voucher will be issued.
- 4.1 Each booking or voucher is subject to the specific terms outlined on the relevant listing.
- 4.2 Vouchers must be redeemed within the stated validity period.
- 4.3 Redemption may require advance booking directly with the Merchant or presentation of a voucher on arrival.
- 4.4 Vouchers may be transferable only where permitted by the Merchant.
- 5.1 Cancellation and rescheduling policies are set by the Merchant and are clearly displayed prior to purchase.
- 5.2 Requests to change bookings are subject to Merchant approval and availability.
- 5.3 Failure to attend a booking (including late arrival) may be treated as a no-show and may result in forfeiture of the booking amount, subject to your rights under New Zealand law.
6.1 Consumer Guarantees Act
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or any other applicable New Zealand consumer protection law.
Where services are not provided with reasonable care and skill, are not as described, or fail to meet statutory guarantees, you may be entitled to a remedy including repair, reschedule, refund, or replacement.
6.2 Refund Policy Hierarchy
Where a refund or remedy is requested, the following order applies:
- Applicable New Zealand law (including CGA and FTA)
- Merchant cancellation, refund, or rescheduling policy
- Funbook facilitation support (where reasonable and applicable)
- Change-of-mind requests (generally not eligible unless required by law or stated on the listing)
6.3 Change of Mind
Due to the nature of time-specific and capacity-limited experiences, refunds for change of mind are generally not available unless otherwise stated or required under New Zealand law.
- 7.1 Merchants are responsible for the delivery, safety, quality, and legality of their services.
- 7.2 Funbook is not liable for any failure by a Merchant to deliver services except as required under New Zealand law.
- 7.3 Any disputes relating to service delivery should first be raised with the Merchant, with Funbook available to assist where reasonable.
- 8.1 We take reasonable care to ensure all information is accurate; however, errors may occur.
- 8.2 Funbook reserves the right to correct pricing or listing errors at any time.
- 8.3 If an error affects your booking, we will contact you with available options, including cancellation or adjustment.
- 9.1 You may be required to create an account to make bookings.
- 9.2 You are responsible for maintaining the confidentiality of your account information.
- 9.3 You are responsible for all activity under your account.
You agree not to misuse the platform, including attempting fraud, reselling vouchers without permission, or using the platform for any unlawful purpose.
- 11.1 To the maximum extent permitted by law, Funbook is not liable for indirect, incidental, or consequential loss or damage arising from your use of the platform.
- 11.2 Nothing in these Terms excludes liability where such exclusion is not permitted under New Zealand law.
Your use of Funbook is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
We may update these Terms from time to time. Continued use of the platform after changes are published constitutes your acceptance of the updated Terms.
